Initial Level - entitlement reviews for all statutory investment incentive entitlements is put on the board.  The program rules are reviewed with the developer so the developer knows what is available here and why it is available.  In most cases, these statutory benefits do not come into being until the project has finished the construction phase and is placed in service; the placed in service date becomes the date the benefits vest.  With that thought in mind, our approach in the past has been to utilize these benefits for the purposes of purchasing various forms of credit enhancements; then

Second Level - condominium plan organizational review.  Most commercial housing transactions offer the opportunity to convert a portion of the living units into a condominium ownership plan that is organized solely for the purpose of allowing its members to receive investment income from their holdings.  We incorporate these funding resources into the last 45 to 60 days of the construction cycle (most states have prohibitions against the developer getting a hold of these funds any sooner - talk to your RMC consultant on this point); then

Third Level - fractional tenants-in-common commercial real estate syndication review.  For the remaining portion of the project that is not used in the condominium plan, we create a fractional tenants-in-common plan (or "TIC plan") syndication program because the TIC plan approach can provide at-risk equity financing as early as the pre-construction phase.
